A settlement was recently reached between the State of Ohio and AIP Logistics in an injunction case in Auglaize County Common Pleas Court.
According to official court documents, the agreement was reached July 21, and the journal entry on the settlement was filed in court on Friday.
The settlement includes a $90,000 civil penalty that AIP will pay to the state over a period of two years. The document indicated the penalty will be paid in three incremental payments of $30,000, one within 30 days of the agreement, one within 12 months and one within 24 months.
The case stems from a chemical leak of ethylenediamine (EDA), which occurred Aug. 26, 2014, with other leaks reported since that time, including as recently as December 2014. These events resulted in an investigation by the Ohio Environmental Protection Agency and ultimately a restraining order against AIP restricting their handling of EDA until proper handling procedures could be developed. That restraining order was issued on Dec. 15, 2014.
Also part of the settlement are provisions that AIP will comply with all applicable Ohio risk management program laws and abide by specific procedures, training requirements and equipment inspection requirements for handling EDA at its facility.
